A Philadelphia man aged 71 received $12.75 million from Monteris Medical after a device broke during a procedure to remove a malignant brain tumor, reports The Philadelphia Inquirer.
Neurosurgeon Kevin Judy, MD, performed the procedure with the NeuroBlate Sidefire device, which broke and penetrated the patient's brain, causing permanent brain damage.
The lawsuit alleged that Dr. Judy, of Thomas Jefferson University in Philadelphia, never used the device to treat this type of tumor before.
Dr. Judy, Jefferson University Physicians, and Thomas Jefferson University were named in the suit, which went to trial. However, a judge ruled a mistrial during the defense's questioning of an expert witness Feb. 21. The case will be relisted for trial, according to the patient's attorney.
